| 1. Purpose and Scope |
These Website Terms of Use (“Terms”) set out the conditions governing access to and use of the official website of Education in Crisis (EiC), accessible at www.eduincrisis.org (“the Website”). They apply to all visitors, users, subscribers, donors, partners, and any other persons who access or interact with the Website in any capacity.
Education in Crisis (EiC) — For Learning Everywhere is a registered non-governmental organisation operating with a Coordination Headquarters in Arusha, United Republic of Tanzania (registered 2023), and field operations in South Kordofan / Nuba Mountains, Republic of Sudan (registered 2020). The Website serves as EiC’s primary digital platform for sharing information, mobilising resources, communicating with stakeholders, and furthering its mission to promote inclusive, equitable, quality education in conflict-affected and marginalised communities.
These Terms apply to all content, features, services, and functionalities available on the Website, including but not limited to programme information, research publications, donation portals, newsletters, media content, and any interactive features. They supplement and must be read together with EiC’s Data Protection Policy, Child Protection and Safeguarding Policy, and PSEA Policy.
| 2. Acceptance of These Terms |
By accessing, browsing, or using the Website in any way — including viewing content, submitting information, making a donation, or sharing any material — you accept and agree to be bound by these Terms, as updated from time to time in accordance with Section 17.
If you are accessing the Website on behalf of an organisation, company, government body, UN agency, or other legal entity, you represent that you have the authority to bind that entity to these Terms, and references to “you” shall include that entity.
If you do not accept these Terms in their entirety, you are not authorised to access or use the Website. Continued use of the Website following any amendment to these Terms constitutes your acceptance of the revised Terms.

The Website is intended for use by adults (persons aged 18 years or older). Persons under the age of 18 may access the Website only under the supervision and with the consent of a parent, legal guardian, or a responsible adult. EiC does not knowingly collect personal data from children under the age of 13 without parental consent.
EiC makes the Website available without charge as part of its public-benefit mission. EiC reserves the right to restrict, suspend, or terminate access to the Website — or to specific features or sections — at any time, for any reason, without notice. EiC may require registration or authentication to access certain sections of the Website.
EiC is committed to digital accessibility and endeavours to ensure that the Website meets internationally recognised accessibility standards. Where technical or resource constraints limit accessibility, EiC will work progressively to address these gaps. Subject to these Terms, EiC grants you a limited, non-exclusive, non-transferable, and revocable licence to access and use the Website for personal, non-commercial purposes only, or for the purposes of legitimate institutional engagement with EiC’s work as a donor, partner, researcher, journalist, or peer organisation.
4.1 Permitted Activities
You may, without restriction:
- View, read, and download publicly available content from the Website for personal, educational, research, or non-commercial reporting purposes;
- Share links to Website pages through social media, email, or other digital channels, provided the content is not misrepresented;
- Submit donations, enquiries, or feedback through designated Website features;
- Access and download EiC reports, publications, and resources that EiC has made publicly available, subject to the intellectual property provisions in Section 5.
| 5. Intellectual Property Rights |
All content on the Website — including but not limited to text, articles, reports, research publications, photographs, video and audio materials, infographics, the EiC logo and visual identity, software, code, and design elements — is the intellectual property of Education in Crisis (EiC) or is used by EiC under licence from third-party rights holders, and is protected under the laws of the United Republic of Tanzania and applicable international intellectual property conventions, including the Berne Convention for the Protection of Literary and Artistic Works.
5.1 Restrictions
Without prior written permission from EiC, you must not:
1. Reproduce, copy, republish, or redistribute any Website content beyond fair use for personal, educational, or non-commercial reporting purposes;
2. Modify, adapt, translate, or create derivative works based on EiC’s proprietary content;
3. Use EiC’s name, logo, visual identity, or any associated marks in any way that implies endorsement, partnership, or affiliation without written authorisation;
4. Extract Website content for commercial gain, including through data scraping, aggregation, or automated collection;
5. Remove, alter, or obscure any copyright notice, attribution, or rights statement appearing on any Website content.
5.2 Attribution
Where EiC content is used under fair use or with EiC’s permission, appropriate attribution is required in the following form: “Source: Education in Crisis (EiC) — For Learning Everywhere, www.eduincrisis.org, [Year].”. For content co-produced with partners, attribution requirements specified by the relevant partner agreement apply.

| 6. User-Generated Content |
The Website may allow users to submit comments, testimonials, feedback, photographs, or other materials (“User Content”) through designated channels such as contact forms, community engagement features, or social media integrations. By submitting User Content to EiC, you:
1. Represent and warrant that you own all rights in the User Content or have obtained all necessary consents and licences to submit it, including consent from any identifiable persons depicted in photographs or videos;
2. Grant EiC a non-exclusive, royalty-free, perpetual, irrevocable, and worldwide licence to use, reproduce, adapt, translate, publish, and distribute the User Content across all EiC’s channels and media, including for fundraising, communications, and advocacy purposes;
3. Confirm that the User Content does not contain any material that is unlawful, defamatory, discriminatory, harmful to children, or that violates any third-party rights;
4. Acknowledge that EiC may moderate, edit, or remove User Content at its sole discretion, without obligation to provide reasons.
6.1 Images and Content Featuring Children
In line with EiC’s Child Protection and Safeguarding Policy and its commitments under the UNCRC, EiC requires that any User Content featuring children be submitted only by a responsible adult (parent, guardian, or authorised programme staff) who has obtained appropriate consent in accordance with EiC’s Safeguarding protocols. EiC will not publish identifiable images of children from conflict-affected contexts without rigorous consent verification.
| 7. Child Safety and Digital Safeguarding |
| Core Commitment: Education in Crisis (EiC) is firmly committed to the safety, dignity, and rights of every child. EiC is a UNICEF Full Capacity Partner (August 2025) and a member of the Alliance for Child Protection in Humanitarian Action (ACPHA). These commitments extend to EiC’s digital presence and online interactions. |
The Website is not designed for or directed at children under the age of 13. EiC does not knowingly collect personal information from children under 13 without verifiable parental or guardian consent. If EiC becomes aware that personal data has been collected from a child without consent, it will take prompt steps to delete such information.
Any user who encounters content on the Website that appears to be harmful to, exploitative of, or inappropriate for children is requested to report it immediately to info@eduincrisis.org. EiC will investigate all such reports and take appropriate action, including referral to relevant authorities where required.
EiC’s digital safeguarding approach is guided by the following principles:
- Do No Harm: EiC will not publish content that could put children or vulnerable adults at risk of identification, targeting, or harm, including content that discloses names, locations, family details, or other identifying information of programme participants in conflict-affected settings;
- Dignity and Consent: All images, stories, and case studies involving children or vulnerable individuals published on the Website are obtained with full, informed, and documented consent from the child (where age-appropriate) and their parent or guardian;
- Reporting Obligation: Any EiC staff or partner who becomes aware of potential online abuse, exploitation, or safeguarding risks involving the Website or EiC’s digital platforms must report this through EiC’s internal safeguarding channels immediately.
| 8. Data Protection and Privacy |
EiC collects and processes personal data from Website users in accordance with its Data Protection Policy and applicable data protection law, including the Electronic and Postal Communications Act (Tanzania) and relevant provisions of the General Data Protection Regulation (GDPR) where applicable to EiC’s processing activities involving EU/UK data subjects.
8.1 Data We Collect
Through the Website, EiC may collect the following categories of personal data:
- Contact and identification data: name, email address, phone number, and country provided through contact forms, newsletters, or donation portals;
- Technical and usage data: IP address, browser type, pages visited, and time spent — collected automatically through standard web analytics tools;
- Donation and financial data: where applicable, processed securely through third-party payment processors — EiC does not store payment card details;

EiC processes personal data for the following lawful purposes: responding to enquiries and feedback; processing donations and issuing receipts; sending newsletters and programme updates (with consent); improving Website functionality and user experience; meeting legal and reporting obligations to donors, regulators, and oversight bodies; and safeguarding the security and integrity of the Website.
8.3 Your Rights
You have the right to access, correct, or request deletion of your personal data held by EiC. To exercise these rights, or to withdraw consent for any data processing activity, contact info@eduincrisis.org. EiC will respond to valid requests within 30 days.

The following conduct is strictly prohibited when using the Website. Violations may result in immediate termination of access, reporting to competent authorities, and civil or criminal liability:
1. Using the Website for any purpose that is unlawful, fraudulent, or harmful under the laws of any applicable jurisdiction;
2. Attempting to gain unauthorised access to any part of the Website, its underlying systems, servers, or databases;
3. Interfering with, disrupting, or degrading the performance, security, or integrity of the Website through denial-of-service attacks, hacking, injection attacks, or any other means;

5. Impersonating EiC, its staff, partners, or donors, or falsely representing an affiliation with EiC;
6. Posting, transmitting, or facilitating content that is defamatory, threatening, harassing, discriminatory, hateful, or that incites violence or harm;
7. Using the Website to solicit funds or resources for purposes not authorised by EiC;
8. Collecting personal data of other Website users through any automated or manual means without authorisation;
9. Using the Website in any manner that could bring EiC into disrepute, undermine donor confidence, or damage EiC’s reputation or programme relationships;
10. Publishing or facilitating content that exploits, endangers, or is harmful to children or other vulnerable persons.

- Damage to devices, systems, or software arising from use of or access to the Website;
- Damages arising from reliance on information obtained through the Website or through any linked third-party website.
This limitation applies regardless of whether such liability arises in contract, tort, negligence, breach of statutory duty, or any other legal theory, and regardless of whether EiC has been advised of the possibility of such damages.
Where statutory consumer protection laws in your jurisdiction do not permit certain exclusions or limitations of liability, those exclusions shall not apply to you to the extent prohibited by law.

You agree to indemnify, defend, and hold harmless Education in Crisis (EiC), its governing body, officers, staff, volunteers, consultants, partners, and representatives from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:
- Your use of or access to the Website in violation of these Terms;
- Your submission of any User Content that infringes third-party rights or is otherwise unlawful;
- Your violation of any applicable law, regulation, or third-party right;
- Any misrepresentation or fraudulent conduct by you in connection with the Website.

EiC is committed to ensuring that the Website is accessible to the widest possible audience, including persons with disabilities. EiC endeavours to align the Website with the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA, as published by the World Wide Web Consortium (W3C).
Where Website content is not fully accessible, EiC will make reasonable accommodations upon request. These Terms and any dispute, claim, or matter arising out of or in connection with them — whether contractual, tortious, statutory, or otherwise — shall be governed by and construed in accordance with the laws of the United Republic of Tanzania, without regard to its conflict of law principles.
For disputes arising from EiC’s field operations in Sudan or involving matters occurring within the Republic of Sudan, the laws of the Republic of Sudan may additionally apply. In cases of conflict between Tanzanian law and Sudanese law, Tanzanian law shall prevail.
You agree to submit to the non-exclusive jurisdiction of the competent courts of the United Republic of Tanzania for the resolution of any dispute arising under or in connection with these Terms. Nothing in this section shall prevent EiC from seeking emergency or injunctive relief in any jurisdiction where such relief may be necessary to prevent irreparable harm.
For users accessing the Website from the European Union or the United Kingdom, nothing in these Terms shall limit your rights under applicable consumer protection or data protection law.
| 17. Updates and Amendments to These Terms |
EiC reserves the right to update, amend, or replace these Terms at any time. Amendments may be made to reflect:
- Changes in applicable law or regulatory requirements in Tanzania, Sudan, or other jurisdictions relevant to EiC’s operations;

EiC commits to reviewing these Terms at least every two years, or more frequently where significant legal or operational changes require it.

EiC will acknowledge receipt of formal complaints within five (5) working days and will endeavour to provide a substantive response within twenty (20) working days. EiC’s governing body reviews complaints relating to safeguarding, data protection, or serious Website misuse at their next scheduled meeting.
